Parents Sue After Alleged Attempted Sexual Assault Of 8-Year-Old In NRG Stadium Restroom

The parents of an 8-year-old have filed a Jan. 12 lawsuit alleging a stadium employee attempted to sexually assault their son in an NRG Stadium restroom during the Texans vs. Cardinals game on Dec. 14. The suit names 21-year-old Ushay Marquise Nixon, Aramark and ASM Global; Nixon faces felony indecency and attempted aggravated sexual assault charges and is jailed ahead of a Feb. 5 hearing. Surveillance footage and a forensic interview are cited in reports, and Aramark says Nixon is no longer employed and is cooperating with authorities. The family reports the child has suffered night terrors since the incident.

The parents of an 8-year-old boy have filed a civil lawsuit after alleging that a stadium employee tried to sexually assault their son inside a bathroom during a Houston Texans game at NRG Stadium on Dec. 14.

Allegations and Lawsuit

Filed Jan. 12 in Harris County, Texas, the complaint names 21-year-old Ushay Marquise Nixon, Aramark Sports and Entertainment Services of Texas, LLC, and ASM Global Parent Inc. as defendants. According to court records and local reporting, the family says the boy — attending his first NFL game — was escorted to a men’s restroom by his mother during the third quarter and emerged adjusting his clothing.

A bystander later told the boy’s mother he had seen the child with an adult employee inside the restroom and that the interaction “didn’t look right.” After questioning by his parents, the child said a man had pulled down his pants. The boy then identified Nixon when his father returned him to the restroom.

Police Interview, Surveillance and Arrest

Authorities say surveillance footage captured a man in a purple polo entering and exiting the restroom around the time of the alleged incident. In a forensic interview with Houston Police, the child described being directed into a locked stall, having his pants and underwear pulled down, and fleeing when the man then lowered his own clothing. Police allege Nixon ran and hid in a storage closet before officers apprehended him.

Per reporting, Nixon allegedly told police he had been assigned to restroom duty and asked the child if he wanted to see his Pokémon card collection; the child reportedly became frightened and ran away.

Criminal Charges, Employment Response and Prior Record

Harris County court records show Nixon is charged with felony indecency with a child and felony attempted aggravated sexual assault of a child under 14. He remains in Harris County jail pending a scheduled hearing on Feb. 5. The civil complaint accuses Aramark of negligent hiring and contends both Aramark and ASM Global failed to provide a safe environment at NRG Stadium.

Aramark issued a statement saying it is aware of the "very disturbing situation," confirmed Nixon is no longer employed by the company, and said it is fully cooperating with authorities. ASM Global did not immediately respond to requests for comment. Court records cited by local outlets also indicate Nixon faced similar charges in 2022, which were later dismissed.

Impact On The Family

The boy’s mother told USA TODAY her son has suffered night terrors since the incident and asked, "Why did God let this happen to me?" The boy’s father told Click2Houston that despite doing what he thought was right to protect his child, he feels he failed. The family's attorney, Anna Greenberg, said the child went to his first NFL game expecting joy and was instead allegedly targeted by an employee who should never have been near children.
