Nevada Supreme Court Clears Way for Criminal Case Against Six 'Fake Electors' in Las Vegas

The Nevada Supreme Court reversed a lower court and allowed the criminal case against six alleged "fake electors" to proceed in Clark County (Las Vegas). Attorney General Aaron Ford charged the defendants nearly two years ago with offering false and forged instruments and submitting a false "Certificate of the Votes of the 2020 Electors from Nevada." Ford said the defendants "cannot evade accountability." Last week's presidential pardons do not apply to state charges.

Nevada Supreme Court Allows Case to Proceed in Clark County

The Nevada Supreme Court on Thursday reversed a lower-court dismissal and ruled that the criminal prosecution of six so‑called "fake electors" may move forward in Clark County (Las Vegas). The decision restores venue for the state charges after a judge had previously found the case was filed in the wrong location.

Nevada Attorney General Aaron Ford brought the indictments roughly two years ago against several senior figures tied to the Nevada Republican Party. Prosecutors allege the defendants falsely presented themselves as the state's presidential electors and submitted a document titled "Certificate of the Votes of the 2020 Electors from Nevada" to the president of the Senate and other officials.

The charges include offering a false instrument for filing, offering a forged instrument, and related offenses. With the Supreme Court's ruling, the matter will proceed under Nevada state law in Clark County, where further pretrial proceedings or a trial will take place.

Aaron Ford: "They cannot evade accountability in Nevada for their unlawful actions. As attorney general, it is my duty to hold those who sought to undermine the results of our state's free and fair election responsible."

The ruling comes after former President Donald Trump last week issued a broad list of pardons covering dozens of people accused of arranging alternate 2020 electors, including the Nevada defendants. Legal observers note those pardons are largely symbolic in this context because they apply only to federal offenses and cannot nullify state prosecutions.

With venue confirmed by the state Supreme Court, the case will continue in Clark County under the Nevada indictments.
