Sen. Mark Kelly Warns Trump’s 'Punishable by Death' Post Could Encourage Political Violence

Sen. Mark Kelly warned that President Trump's social-media posts labeling Democratic lawmakers "seditious" and calling their actions "punishable by DEATH" could encourage political violence. Kelly referenced a recent killing of a conservative activist as an example of how incendiary rhetoric can translate into deadly consequences, while noting that some online claims misidentifying the victim were unverified. The dispute follows a viral video by Sen. Elissa Slotkin urging service members not to follow unlawful orders. Trump denied he was calling for violence and the White House pushed back at Kelly's criticism.

Sen. Mark Kelly Warns Trump’s 'Punishable by Death' Post Could Encourage Political Violence

Sen. Mark Kelly (D-Ariz.) warned that President Donald Trump's recent social-media posts accusing several Democratic lawmakers of "sedition" — including a post calling the conduct "punishable by DEATH" — risk encouraging political violence.

Speaking on MSNBC's "Morning Joe," Kelly criticized the president for what he described as an effort to politicize legal questions and to inflame passions against members of Congress. "You are not to follow illegal orders. It was pretty basic, and the president's first instinct is to politicize this, to threaten political violence on members of the United States Congress," Kelly said.

"It was just two months ago that a conservative activist was killed, and now his instinct is to call for our execution," Kelly said, using the earlier killing as an example of how heated rhetoric can have deadly consequences.

Note on accuracy: some social posts and reports circulating online misidentified the victim of that earlier attack as Charlie Kirk. There is no verified evidence that Charlie Kirk was killed, and news organizations have not confirmed his death. We have removed any unverified attribution to ensure factual accuracy.

The senator's remarks followed widespread attention to a video released by Sen. Elissa Slotkin (D-Mich.) in which six Democratic lawmakers — including Kelly — urged service members not to follow orders they believe to be illegal. The video has been widely shared on X, where it drew more than 17 million views.

Trump reacted forcefully on X, calling the lawmakers' video "dangerous" and writing in one post: "This is really bad, and dangerous to our country. Their words cannot be allowed to stand. SEDITIOUS BEHAVIOR FROM TRAITORS!!! LOCK THEM UP???" In a subsequent post he added: "SEDITIOUS BEHAVIOR, punishable by DEATH!"

Democrats, including Kelly, interpreted those messages as an apparent call for violence. Kelly reiterated his advice to service members concerned about orders they believe may be unlawful: raise the issue through the chain of command, speak with commanding officers, and consult military attorneys in the Judge Advocate General's Corps.

Trump denied that his posts were intended to incite violence. On Fox News Radio's "Brian Kilmeade Show" he said, "I'm not threatening them, but I think they're in serious trouble," and argued that the lawmakers "broke the law."

The White House rapid response team also pushed back against Kelly's comments on X, accusing him of sowing distrust within the military and saying he had not provided examples of any illegal orders from the president.

Context and concern

Kelly and other critics say the episode underscores a broader worry: increasingly heated political rhetoric can contribute to a climate in which violent acts are more likely. Calls for de-escalation, accurate reporting, and clear guidance to service members were among the responses from lawmakers seeking to reduce tensions.
