SpaceXAI — the data‑center operation tied to Elon Musk’s AI projects — is facing a $30 million lawsuit after a worker fell at the Colossus II facility in Memphis, Tennessee, court papers and local reporting say.
Incident Details
The fall occurred in August 2025 at the Colossus data‑center campus, originally developed by xAI and later integrated into SpaceXAI. According to a lawsuit filed in August 2026 and obtained by The Commercial Appeal, Alexis Vicent, who was employed through Employer Solutions Staffing Group, fell from a mezzanine on his first day at the Colossus II site.

Allegations and Investigation
The complaint alleges the mezzanine lacked an appropriate anchor point for a safety harness and was missing required fall protections, including guardrails, safety nets, lifelines and a functioning personal fall‑arrest anchorage system. The suit says Vicent could not secure his harness and, while transitioning between two elevated mezzanines, fell approximately 25–30 feet onto a concrete floor, sustaining catastrophic injuries.
The family’s filing cites a Tennessee Occupational Safety and Health Administration (TOSHA) investigation that, according to the lawsuit, found the worker was "not protected from fall hazards while walking/working on and around the mezzanine area, thereby exposing him to a hazard." Vicent later died in Florida in February, several months after the fall.

Damages Sought
The family is seeking a jury trial and $30 million in damages; $20 million of that sum is described in the complaint as punitive damages. The suit notes that the punitive request represents roughly 0.1% of the data‑center project’s investment costs, according to the filing.
Broader Context
The Colossus campus—promoted by its operator as a "gigafactory of compute"—has been central to work tied to Grok, an AI system associated with Elon Musk. The site has also faced environmental scrutiny over on‑site gas turbines. In April, the Southern Environmental Law Center and Earthjustice said they were representing the NAACP in legal action against the site’s operators over air‑pollution concerns.
SpaceXAI announced in July that it had agreed a timeline with the Mississippi Department of Environmental Quality to remove the turbines, and that all units would be removed by July 2027.
Company Response
The Independent and other outlets have contacted SpaceX and Butler Snow, the law firm representing SpaceXAI, for comment. Separately, SpaceX President Gwynne Shotwell said on the All‑In podcast that Elon Musk had been spending time on site in Memphis during the buildout.
