What Happened
The complaint, filed Sept. 24 in federal court in Tampa, names dealership owner Michael Murphy as the vehicle’s primary user. Murphy was out of state when the storm hit; his wife, Sylvana, their young daughters and Sylvana’s parents were at the house on Tampa’s Interbay Peninsula when the incident occurred.

When Hurricane Helene made landfall on Sept. 26, 2024 as a Category 4 storm, the property was hit by a severe storm surge. The suit says floodwaters filled the ground-floor garage and submerged the Tesla’s undercarriage. Sylvana reportedly heard an explosion, then found the vehicle ablaze; the fire spread rapidly through the garage and ultimately consumed the entire residence.

Rescue and Losses
Rising floodwaters blocked emergency vehicles from reaching the home. A team from Grey Bull Rescue, a Tampa-based organization run by former military personnel, reached the house by boat and evacuated the family. The suit states the rescuers’ efforts saved the family’s lives, but the blaze destroyed the five-bedroom, six-bathroom home and killed the family dog.

Allegations Against Tesla
The Murphys’ complaint alleges the fire was caused by "the batteries themselves and the design of the battery pack" and contends Tesla knew lithium-ion batteries could enter thermal runaway when exposed to water. The filing says Tesla received multiple warnings about water-triggered battery fires and had access to protective technologies — including patents for intumescent fire-retardant materials dating back to 2010 — but did not implement them.
"Without Grey Bull Rescue's efforts, there would have been no way for the family to escape and they would have died in the fire," the complaint states.
Context and Related Incidents
The filing cites broader concerns about lithium-ion battery behavior in saltwater, including a 2022 warning from U.S. Sen. Rick Scott about water-triggered thermal runaway and other reported incidents during Hurricane Helene and elsewhere where Teslas allegedly caught fire after saltwater exposure. The complaint also references unrelated 2024 incidents involving a charging cable fire and an intense Tesla Cybertruck blaze reported in other lawsuits.
Tesla did not respond to a request for comment, and the family’s attorney, Samuel Heller, declined further comment citing active litigation. The Murphys are seeking compensatory and punitive damages and have asked for a jury trial, alleging negligence and design and manufacturing defects.
