Conservative figures quickly seized on the timing of Alvarez's death, noting that it occurred in 2023 during the Biden administration. Tim Murtaugh, who served as a communications director for Donald Trump’s 2020 campaign, mocked Bates on social media for apparently not acknowledging that the death occurred while Bates served in the administration. Greg Price, a former rapid response manager in the Trump White House, also called attention to the year of the incident.

Bates' Defense

Bates replied to critics in the post's comment thread, reiterating his position: “I stand by what I said. It’s horrible and shouldn’t have happened.” He also wrote that he was proud the American people were rejecting what he described as “the cruelty that ICE is forcing on Americans and immigrants, putting all of us in danger,” and said he hoped opponents could agree on opposing such cruelty.

The agents involved were placed on administrative leave. Pretti’s death followed the killing of Renee Nicole Good, 37, in a separate shooting by a federal agent.
