Kentucky Couple Indicted After Allegedly Throwing Neighbor From Second‑Story Balcony; Victim Dies

The Durbins, neighbors at an Elizabethtown apartment complex, were indicted on murder charges after a witness says they dragged 62‑year‑old Bobby Pennington from a doorway and threw him over a second‑story balcony on Nov. 13. Pennington died at a hospital on Nov. 17 from injuries sustained in the roughly 11 ft 6 in fall. Shawn Durbin also faces assault and resisting‑arrest counts. Both are held at the Hardin County Detention Center and are due for arraignment on Dec. 9.

A Kentucky couple has been indicted on murder charges after a 62‑year‑old neighbor was allegedly thrown from a second‑story balcony at an Elizabethtown apartment complex.

Authorities arrested 39‑year‑old Shawn Durbin and 36‑year‑old Nancy Ann Durbin following an incident at an apartment complex on East Memorial Drive on Nov. 13. Officers were initially called for an adult male in cardiac arrest and were later informed the man had been thrown from the building's second‑story balcony.

The victim, identified as 62‑year‑old Bobby Pennington, was first taken to Baptist Health and then transferred to a university hospital, where he died on Nov. 17 from injuries sustained in the fall. Prosecutors upgraded the couple's initial first‑degree assault arrests to murder charges after Pennington succumbed to his injuries.

What witnesses reported

According to a police citation, a witness saw the pair "physically drag the victim from in front of [an apartment] which belonged to the Durbins, and then throw him over the second‑story balcony handrail." The citation states the fall measured approximately 11 feet 6 inches onto a concrete pad below.

"While our officers were responding, they were updated that the individual in question had been thrown from a second‑story balcony," said Elizabethtown Police Public Information Officer Chris Denham. He added investigators believed there had been a dispute beforehand but had found no clear motive.

Charges and legal status

A grand jury returned indictments for both Shawn and Nancy Durbin on Nov. 20. In addition to the murder charge, Shawn Durbin faces two counts of third‑degree assault and one count of resisting arrest; police allege he attempted to kick out a patrol car window, spat on an officer and fought with responding officers during his arrest. Both defendants are being held at the Hardin County Detention Center and are scheduled for arraignment on Dec. 9.

Authorities continue to investigate the events that led to the confrontation and the fatal fall.
