The complaint names former teacher Chynia Johnson and accuses Arka Risinger Educators of negligence, negligence per se, and gross negligence, according to reporting by ICLG News. Court papers identify the victim only as UH and say Johnson urged her own son, also enrolled at the center, to attack the Harris child. The suit additionally alleges Johnson shook UH, causing him to fall.
Heather Harris reportedly discovered her son "hysterically and uncontrollably" crying when she picked him up on April 27.
Family Statement and Wider Impact
Russell T. Button, the Harris family attorney, told WFAA the scene at the nursery resembled "a child fight club," saying the child was "thrown around like a human rag doll by somebody that was supposed to protect him."
"When you speak up, when you bring these things to light, it helps hold everyone accountable, and that makes other daycares take notice," Button said, urging improved safety and accountability for childcare providers.
The lawsuit seeks monetary compensation and aims to prompt accountability and changes to ensure safer care environments. These are allegations and will be determined through the legal process.
