Family Sues Tesla After Model 3 Crashes Into Katy, Texas Home, Killing 76-Year-Old

The Barbour family has filed a wrongful-death lawsuit after a Tesla Model 3 reportedly using driver-assist left the roadway and crashed into their Katy, Texas, home, killing 76-year-old Martha Avila. Court papers identify the driver as Michael Buter and allege the vehicle was operating with an automated driving assistance system; investigators estimate speeds above 70 mph. Tesla executives posted that the driver may have overridden autopilot and fully depressed the accelerator. Local and federal agencies, including NHTSA and NTSB, are investigating while the family seeks Tesla's crash data and more than $1 million in damages.

The family of a 76-year-old woman killed when a Tesla crashed into her Katy, Texas, home last Friday has filed a wrongful-death lawsuit accusing the automaker and the vehicle's driver of negligence.

Wrongful-Death Suit Filed

Jennifer and Justin Barbour, the daughter and son-in-law of the victim, Martha Avila, filed the complaint Tuesday in Harris County District Court. The suit names Tesla and the driver—identified in court papers as Michael Buter—as defendants and alleges the vehicle was operating with an automated driving assistance system at the time of the crash.

What Happened

According to law enforcement statements and court filings, the Tesla Model 3 left the roadway at about 8 p.m., failed to remain in a single lane and struck the brick residence. Avila was inside her front room when the car entered the house. She was airlifted to a hospital and later pronounced dead. Justin Barbour, who was also in the home, suffered injuries.

"What we have is a horrific — and what we believe will be proven preventable — crash amid a rising number of autonomous-vehicle collisions," said attorney Ryan Zehl, who represents the Barbour family. He added investigators estimate the vehicle was traveling at speeds exceeding 70 mph when it struck the house.

Statements From Tesla Executives

Tesla CEO Elon Musk commented on the incident on X, saying, "Yes, this makes no sense. FSD drives slowly through neighborhood streets and this was a high speed crash!" Ashok Elluswamy, Tesla's head of AI, also posted on X, asserting the vehicle's automated mode had been manually overridden and that the accelerator was fully depressed, reaching about 73 mph during the crash.

Evidence and Ongoing Investigations

Zehl emphasized that social-media posts do not replace formal evidence. He noted Tesla maintains a "collision snapshot" system that transmits crash-related data to its servers and said the family will seek access to that information. The crash is being investigated by local authorities as well as federal agencies, including the National Highway Traffic Safety Administration (NHTSA) and the National Transportation Safety Board (NTSB). No criminal charges had been filed as of Wednesday afternoon.

Impact on the Family

The lawsuit, seeking more than $1 million in damages, also alleges Tesla has repeatedly marketed its self-driving features as safe; it cites at least 13 NHTSA probes into Tesla's driver-assistance systems since 2016. Zehl said the Barbour family has been living in a hotel since the crash because their home is uninhabitable and that they are making funeral arrangements and caring for three children affected by the loss.

"We need to understand: Is this technology actually as safe as companies like Tesla claim in their marketing materials? Because if it is, we should not see crash rates," Zehl said.

Investigations are ongoing and the family is seeking answers about the vehicle's recorded data and broader safety measures for automated-driving systems.
