Texas retailers must stop selling a range of Delta‑8 and other hemp‑derived THC products beginning July 31 after the Texas Department of State Health Services (DSHS) reclassified several non‑delta‑9 THC isomers as controlled substances.
What Changed
In a rule change published in the Texas Register on July 10, DSHS updated the definitions of "Tetrahydrocannabinols" (THC) and "Marihuana Extract." The revised definitions explicitly include several hemp‑derived isomers — such as Delta‑8, Delta‑10, THCP and other non‑delta‑9 cannabinoids — bringing those products under the state's controlled‑substance framework.
Retailer Guidance And Deadline
On July 27, the Texas Hemp Business Council advised members and retailers that sales of affected products must cease after July 31. Businesses were urged to audit inventory and either remove or sell through any items that contain more than trace amounts of the now‑covered cannabinoids before the deadline.
How This Relates To Federal Law
Federal law (the 2018 Farm Bill) legalizes hemp and many hemp products that contain no more than 0.3% delta‑9 THC by dry weight, but state law controls what may be sold and possessed within a state. The DSHS reclassification governs sales and possession in Texas regardless of federal hemp provisions.
Why These Products Are Regulated
Delta‑8 is present in hemp in very small amounts and is often manufactured by converting other cannabinoids into the Delta‑8 isomer. It can produce intoxicating, psychoactive effects similar to Delta‑9 THC, though it is a distinct compound.
THCA is commonly sold as raw hemp flower and is non‑intoxicating in its acid form. When heated through smoking, vaping or cooking (a process called decarboxylation), THCA converts to Delta‑9 THC and produces the same psychoactive effects as cannabis.
What Consumers And Businesses Should Know
Retailers, manufacturers and consumers in Texas will need to act quickly to comply with the rule change. Those unsure how the change affects specific products should consult legal counsel or state guidance. The state continues to allow limited medical use of low‑THC cannabis under Texas' Compassionate Use Program for qualifying patients.
