South Carolina Man Arrested After Minor Gave Birth In Hospital Parking Lot; Faces Incest and Sexual Abuse Charges

A 43-year-old South Carolina man has been arrested and charged after authorities say a minor gave birth in a hospital parking lot and later identified him as an abuser. Officials say the alleged abuse spanned multiple years and that investigators are continuing their probe.

Charges and Allegations

Luis Armando Argueta Montejo, 43, was charged with one count of incest and three counts of second-degree criminal sexual conduct involving a minor, the Oconee County Sheriff's Office (OCSO) said in a news release. The criminal sexual conduct counts allege the victim was between the ages of 11 and 14 and that the abuse occurred between 2022 and 2025.

How the Investigation Began

Deputies say the investigation began on April 11, when a minor was found giving birth in the parking lot of Oconee Memorial Hospital. The girl, who was with an adult female at the time, was transported to the hospital where she delivered the newborn. After the delivery, deputies met with an agent from the Department of Social Services and turned the case over to the Violent Crimes Unit of the Criminal Investigations Bureau.

“Based upon evidence that was obtained during the investigation, and after presenting that evidence to a judge, probable cause was established that Montejo had engaged in sexual intercourse with the victim between 2022 and 2025,” the OCSO wrote in its release.

Arrest, Custody and Next Steps

Investigators obtained a warrant and arrested Montejo on April 16. He remains in custody at the Oconee County Detention Center on an $80,000 surety bond. Shortly after his arrest, U.S. Immigration and Customs Enforcement (ICE) placed a detainer that could require he remain in custody for up to 48 hours after any release by local authorities should he post bond.

Both the minor and her newborn were placed in emergency protective custody. Investigators are awaiting paternity test results to determine whether Montejo is the child’s father. The OCSO said the investigation currently involves one minor female and that detectives continue to investigate the circumstances surrounding the alleged abuse and the birth.
