Federal Judge Dismisses Indictment Against LA TikTok Streamer After Lawyers Were Denied Access

LOS ANGELES (AP) — A federal judge on Saturday dismissed the criminal indictment against popular Los Angeles TikTok streamer Carlitos Ricardo Parias, ruling that his constitutional rights were violated when federal authorities repeatedly prevented his criminal defense lawyers from meeting or consulting with him while he was held in immigration custody.
U.S. District Judge Fernando Olguin ordered the indictment dismissed with prejudice, barring the government from refiling the same charges. Olguin said the overlapping actions and lack of coordination between federal agencies created a situation that produced — and allowed — constitutional violations to occur.
“In short, the government’s failure to coordinate the overlapping actions of its separate agencies while relentlessly pursuing Mr. Parias’s criminal proceedings created a situation from which constitutional violations could — and did — occur,” Olguin wrote.
Parias had been indicted last month and pleaded not guilty to counts including assault on a federal officer with a deadly or dangerous weapon and depredation of government property. The charges stem from an October incident in which authorities say Parias rammed his vehicle into federal agents who were seeking to arrest him on an immigration warrant; Parias was shot in the elbow and was initially hospitalized.
After being released on bond pending trial, Parias was transferred to an Immigration and Customs Enforcement (ICE) detention facility in Adelanto, California — about 70 miles (113 kilometers) northeast of downtown Los Angeles — which is operated by The GEO Group. Court filings show defense attorneys were repeatedly denied meaningful access to their client while he remained in that facility, impairing trial preparation.
The U.S. Attorney’s Office in Los Angeles said it strongly disagrees with the court’s account and legal conclusions and is evaluating whether to appeal. U.S. authorities have said Parias is a Mexican national living in the United States without authorization. Journalists seeking comment left a message for immigration attorney Carlos Jurado.
Parias is well known in South Los Angeles for Spanish-language videos on two TikTok accounts that together have more than 340,000 followers. His posts document police and immigration enforcement activity, community events, accidents and everyday life in the neighborhood. He is one of several social media users who monitor and relay information about immigration raids and arrests across Southern California.
