These platforms let users buy and sell contracts that pay out based on real-world events, from sports and awards to elections and geopolitical outcomes. Operators such as Polymarket and Kalshi say they operate as financial exchanges, not traditional sportsbooks, and they generate revenue through transaction fees rather than betting against customers. That distinction has allowed them to operate nationwide, including in U.S. states where some forms of gambling are restricted.

Controversy Over Timing And Payouts

The unusually timed large bets tied to the Maduro outcome have raised questions about whether the bettor had access to inside information. Polymarket came under particular fire: after adjudicating a related market that asked whether the U.S. would "invade" Venezuela, the company ruled Maduro’s removal a "snatch-and-extract" rather than an invasion and declined to pay that market’s holders — a decision that angered some users.

“They’re growing really quickly. They’re not really regulated in a way that sportsbooks are or other forms of gambling,” said Dustin Gouker, a writer who covers gambling and prediction markets. “Right now, we’ve seen the CFTC kind of have this laissez-faire attitude, and they’re just kind of letting things happen.”

Scale, Partnerships And Industry Outlook

During the 2024 election cycle, billions of dollars flowed through prediction-market platforms, and in some instances market prices tracked public sentiment more accurately than traditional polls. Industry insiders say the sector could expand significantly; Polymarket and Kalshi have already struck deals with major media and sports organizations, including Google, CNN, CNBC, Dow Jones, the UFC and the NHL.

Regulation, Legal Recourse And Political Concerns

Legal experts told NewsNation that customers contesting denied payouts will likely face the platforms’ terms of service and arbitration clauses, which can limit recovery options. Meanwhile, some lawmakers are considering new rules. Representative Ritchie Torres (D-N.Y.) has proposed legislation to bar federal officials from trading on prediction markets using nonpublic information — an effort aimed at preventing insider abuse similar to insider-trading restrictions in securities markets.

The controversy is further complicated by political connections: the White House nominee to lead the Commodity Futures Trading Commission reportedly sits on Kalshi’s board and owns company stock, and Kalshi lists Donald Trump Jr. as a strategic adviser. Those ties have prompted additional questions about conflicts of interest and oversight.
