Body Language Experts Decode Fauci’s Contained Response After He Pleads the Fifth at Senate Hearing

Dr. Anthony Fauci invoked the Fifth Amendment at a Senate Homeland Security and Governmental Affairs Committee hearing, repeatedly declining to answer questions about COVID‑19's origins to avoid potential perjury exposure. Body language experts told HuffPost that Fauci appeared controlled and measured, using minimal facial expression and restrained gestures while repeating the same formal refusal. Analysts contrasted his calm demeanor with Sen. Rand Paul's more restless behavior and noted small stress micro‑signals, such as brief blinking and hand‑rubbing. Paul has scheduled an Aug. 5 committee vote to consider holding Fauci in contempt of Congress.

Dr. Anthony Fauci invoked his Fifth Amendment right to decline answering senators' questions at a Wednesday hearing of the Senate Homeland Security and Governmental Affairs Committee, saying he would not risk potential prosecution for perjury as lawmakers renewed their probe into COVID-19's origins and the federal response to the pandemic.

The decision surprised attendees and drew sharp criticism from Committee Chairman Sen. Rand Paul (R-Ky.), who has urged the Justice Department to pursue criminal charges. In his opening remarks Fauci accused Paul of pursuing him to provoke a response that could be used to justify prosecution:

"Sen. Paul's obvious obsession with calling for my prosecution, his repeated slanderous comments about me, and recently his publicly releasing my unredacted personal diary, aimed at embarrassing and intimidating me, the only conclusion I can reach is that the sole reason he is calling me before this committee is to get me to say something — anything — that could vindicate his repeated public pledges that I end up, in his words, 'behind bars.' Any reasonable person who has followed his unhinged obsession with me would readily come to the same conclusion."

What Body Language Experts Noted

Several behavioral and body language analysts who reviewed the hearing footage told HuffPost that Fauci appeared controlled, deliberate and measured. Abbie Marono, a behavioral scientist, described his posture and facial behavior as restrained: "His posture remains relatively rigid, his facial movement is limited, and he deliberately reduces the gestures and expressive reactions that have characterized many of his previous congressional appearances."

Marono noted that Fauci — who served as director of the National Institute of Allergy and Infectious Diseases (NIAID) from 1984 until December 2022 — answered each question with the same formal response: "On the advice of counsel, I respectfully decline to answer based upon my rights under the Fifth Amendment to the Constitution." That repetition, she said, reinforced a deliberate nonconfrontational stance: he was refusing to engage beyond the legal minimum.

Susan Constantine, a body-language and deception expert, observed that Fauci's decades of congressional experience — he told the panel he has testified "well over 200 times" — likely contributed to a composed, camera-ready presentation. Constantine also said Fauci did not display overt psychophysiological signs (like prolonged fidgeting or looking down) that often indicate uncertainty, though she and others noted subtle micro-signs when Paul spoke.

Traci Brown, another analyst, contrasted Fauci's steadiness with Sen. Paul's more restless on-camera manner: "He's swiveling around in his chair and bouncing a bit. He's the less confident one," she told HuffPost.

Micro-Expressions and Stress Signals

While experts emphasized Fauci's controlled appearance, they pointed to small stress indicators during some exchanges, such as brief blinking and subtle hand-rubbing behind his nameplate. Constantine called those "self-soothers" that can surface even when someone is purposefully projecting confidence.

Aftermath and Next Steps

At the hearing's close, Sen. Paul warned the committee would "have to consider … what appropriate action should be taken against you for the failure to testify after being directed to do so." He later pushed for a committee vote scheduled for Aug. 5 to decide whether to hold Fauci in contempt of Congress.

Fauci has been the target of repeated attacks and conspiracy theories, primarily from right-wing critics. The article reports that President Joe Biden issued Fauci a pardon on Jan. 19, 2025, covering alleged offenses since 2014 related to COVID-19 or his official duties; the pardon reportedly does not apply to conduct after that date.

This hearing underscores both the legal and political tensions surrounding congressional investigations into the pandemic and highlights how nonverbal behavior can influence public interpretations of high-profile testimony.
